TERMS AND CONDITIONS

These terms and conditions are governed by English Law and apply to all transactions between IVORY TREE DESiGNS and you. By using our website you are agreeing to these terms and conditions.

PAYMENT

Online payments are made through our secure server - PayPal. Payment can be made via Visa, Visa Electron, Mastercard, Switch and Solo. You do not need to have a PayPal account to make payments using your card - just fill in your card details at the checkout. 

To pay by UK cheque or Crossed Postal Order simply cut and paste the product details, along with the quantity required, into an e-mail and send to sales@ivorytree.co.uk.  Please ensure that your email includes your name, address, and daytime phone number, in case we need to clarify any aspects of your order. You will then be sent an e-mail confirming that your order has been received. 

Alternatively, you can send your order details along with your name and address, by post to: IVORY TREE DESiGNS, 16 Horseshoe Way, Hampton Vale, Peterborough, Cambridgeshire, PE7 8LG. Please ensure that you include your name, address, email address and daytime phone number, in case we need to clarify any aspects of your order. You will then be sent an e-mail confirming that your order has been received. 

For customised or bespoke orders, where you need a quotation as it is not possible to calculate the final price, or you wish to get an idea of price prior to making a final decision, we will email this to you. Prices and any other terms included on quotations will be valid for 28 days. Payment for bespoke orders can be made, online, or by cheque as above.

For small items, it may be possible for us to send these items by Royal Mail First class or First class Recorded deliver please contact us for details.

Prices listed are in UK Pound Sterling and include VAT at the prevailing rate of 15%

Prices of our products are correct at time of entering information. However, we reserve the right to change prices at any time and without prior notice.

Whilst every care is taken to represent the goods accurately in the photographs shown, some variations in the image and colour may occur due to limitations and variations in software, browsers and monitors. Any references to product size and height is approximate only. However, we do try to make these as accurate as possible.

CONTRACT iNFORMATiON

All orders made by you to this website are subject to successful payment, acceptance and availability. We reserve the right to not accept or to cancel your order up to the point of despatch for any reason. We will notify you via e-mail if this occurs.

OWNERSHIP OF GOODS

All goods supplied by IVORY TREE DESiGNS remain the property of IVORY TREE DESiGNS until full payment has cleared into our bank account.

IVORY TREE DESiGNS provides the IVORY TREE DESiGNS website 'as is' and does not warrant that functions contained in the material contained in this website will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available, are free of viruses or bugs or represents the full functionality, accuracy or reliability of the materials.

In addition, IVORY TREE DESiGNS makes no (and disclaims all) representations or warranties of any kind, express or implied, with respect to the IVORY TREE DESiGNS website or the information or content included in this website.

This does not affect your statutory rights in relation to the goods and their fitness for purpose and satisfactory quality.

IVORY TREE DESiGNS reserves the right to amend these conditions from time to time and without prior notice.

RETURNS & REFUNDS POLiCY

We offer a 14 day "no quibble" returns policy, for all items that are not made to order. If you are not completely satisfied with your purchase, for whatever reason, you can simply return the item back to us for a full item price refund. The original carriage costs are non refundable. 

If you do wish to return an item, the following conditions will apply:

• You should notify us via e-mail within 5 days of receiving your purchase, that you are wishing to return the item/s, stating reason for return.  Please contact us at sales@ivorytree.co.uk.
• Goods should be returned in their original packaging and in resaleable condition, with tags still attached (if item is accompanied with tags) along with the delivery note.
• Item must be received back to us within 14 days.
• The cost of returning the goods shall be borne by you.     

All items returned by you are at your own risk, therefore we advise you to check that the item is properly addressed and adequately packaged. We also strongly recommend obtaining proof of postage and using a traceable and secure delivery agent e.g. Recorded Delivery via Royal Mail, when returning goods as we cannot be held responsible for goods lost in transit. Once item is received back, refund will be made within 14 days, credited back to the original card of payment, or if payment was made via cheque or postal order, refund will be issued via cheque.

Due to the nature of customised or made-to-order items, these are not refundable, unless found to be faulty. These items will be clearly marked as *Customisable* and/or *Made to Order* within the product description

FAULTY AND DAMAGED iTEMS

We carefully check and package all items before despatch, but if in the unlikely event that you do receive an item that you deem to be damaged or faulty please notify us via email at: mail@ivorytree.co.uk within 24 hours of receiving the item, stating the nature of the fault or damage and return within 14 days. Please read the notes above, regarding our recommendations on safely returning items to us.

Once the item is returned it will be checked by us and if it is found to be faulty or damaged as described by you, we will issue you with a full refund or replacement, including both the original postage and return postage costs. (We will need to see a copy of the return postage receipt in order for us to credit you with this cost). Refund will be issued via the same method of payment.

If the returned item is found not to be faulty or damaged after it is checked, we will refund the item price only - no postage costs will be refunded.

AVAiLABiLiTY

If all the items you have ordered are in stock your order will be despatched immediately. Due to the bespoke nature of many of our products, delivery times can vary considerably. We aim to deliver within 14 days, however, please allow up to 28 days for delivery. If you have a deadline that you need to meet please make a note on your order and we will try to help out.

HOW TO PAY

You can either phone us with your credit/debit card details or send a cheque made payable to IVORY TREE DESiGNS. We regret that we cannot despatch any order unless payment has been received in full. Credit card payments will not be processed until the day the order is dispatched but cheques will be processed upon receipt and goods will not be shipped until the cheque is cleared. For regular payments we accept Bank Transfer payments. Please call us for details.

DELiVERY

Delivery by courier to mainland England, Wales, Northern Ireland and Scotland is £12.50 per consignment. For Scottish islands, the Channel Islands, Isle of Man, Isle of Wight and the Republic of Ireland the cost is £25.00 per consignment. For other areas please contact us. Our delivery charge is a one-off charge per order, no matter how many parcels are involved, and provided the order leaves us on the same day. If you require part of the order to be sent ahead, then a separate amount for carriage will be charged. Delivery is via a parcel dispatch company and does require a signature. Please check your goods before signing or inform the courier in writing that the goods have been unchecked and then sign for them. Please let us know of any special instructions that you may have regarding delivery.

We may sometimes send bespoke items to you direct form the manufacturer, in order to reduce lead times to you. If for any reason IVORY TREE DESiGNS makes the decision to send items in more than one delivery, you will be notified, and you will only incur one delivery charge.

 NB: IVORY TREE DESiGNS cannot take responsibility for third party contractors' costs.

 
DiSTANCE SELLiNG DIRECTiVE
The Distance Selling Directive applies to any consumer distance contract made under the law of an EU-Member State as well as the European Economic Area (EEA). It provides a number of fundamental legal rights for consumers in order to ensure a high level of consumer protection throughout the EU. These include:

	Provision of comprehensive information before the purchase;
	Confirmation of that information in a durable medium (such as written confirmation);
	Consumer's right to cancel the contract within a minimum of 7 working days without giving any reason and without penalty, except the cost of returning the goods (right of withdrawal);
	Where the consumer has cancelled the contract, the right to a refund within 30 days of cancellation;
	Delivery of the goods or performance of the service within 30 days of the day after the consumer placed his order;
	Protection from unsolicited selling;
	Protection from fraudulent use of payment cards;
	Non validity of any waiver of the rights and obligations provided for under the directive, whether instigated by the consumer or the supplier.

There are also some exemptions from the right of withdrawal. These will apply unless the consumer and supplier agree otherwise. These exemptions cover, for instance, goods made to the consumer's specifications and perishable goods.
